What is SPAM?
SPAM according to Wikipedia is the use of electronic messaging systems (including most broadcast media, digital delivery systems) to send unsolicited bulk messages indiscriminately. Certain countries define SPAM simply as the sending of unsolicited emails to users who have not requested it.

How do I avoid being a SPAMMer?
The only way to be 100% certain you are avoiding being defined as a SPAMmer in most countries, including: America, Australia, England, New Zealand and South Africa, you must apply an Opt-In methodology when creating your database. Basically you need to obtain your client's permission before sending them emails.

Things to do and to avoid
  1. Do not import or use a purchased database list of any kind;
  2. Do not use return addresses that you do not directly own or have written permission to use;
  3. Do not place any false or miss-leading information in your email or subject;
  4. Do not send messages to generic addresses where you do not have a direct contact person (e.g. webmaster@mydomain.co.uk; info@readytosend.com, etc.)
  5. Make sure your any emails you send have an opt-out / unsubscribe option.
  6. Make sure any unsubscribe requests are processed within 10 days (USA) and within 15 days (Europe and South Africa)
